Payment Policy

Definitions

A. "Applicant" means any person(s) who is/are potential Vacationer/user who has applied for membership to Karlton Assets & Developers.

B. "Vacationer/User" means the applicant whose application for membership has been approved by the Management/authorized person of Karlton Assets & Developers and in whose name the Karlton Holidays certificate is issued on the realization of the Down payment.

C. "ANNUAL MAINTENANCE CHARGES" or "ANNUAL SUBSCRIPTION FEES" means the charges which are decided by the Management of Karlton Assets & Developers to be paid by the Vacationer/User every year.

D. "INTERNATIONAL EXCHANGE FEES" means the fees which the vacationer has to pay, to access various facilities as prescribed by the Government/service providers of the respective nations, before the booking and which may vary from time to time.

E. Purple Season means the period of Diwali week and Christmas to New Year.

F. White Season means the time of the year which is not earmarked as "Purple Season".

1. APPLICATION PROCEDURE

The application for membership to Karlton Assets & Developers. may be made as per the prescribed format approved by the management ("Application Form") that forms a part of the Membership Terms and Conditions.

The Membership is subject to the Terms and Conditions, the rules and regulations made thereunder and as amended from time to time by the management and as notified to the members by putting up a copy thereof at the Office Premises/Website or any other suitable place ("Rules and Regulations").

The Terms and Conditions include the FEE STRUCTURE for the Membership as on the date thereof as amended from time to time by the Management. Further PLAN & FEE STRUCTURE ARE FORMING PART OF THIS AGREEMENT.

The Management of Karlton Assets & Developers. vests exclusively in the Partners of Karlton Holidays and its authorized executives and who in these Rules and Regulations are referred to as "Management". The Management reserves the right to reject or to conditionally accept the Application Form without assigning any reason whatsoever. A member ("Member") is a person whose application has been accepted by the Management/authorized persons.

A member has the right to use the facilities provided by Karlton Assets & Developers. on the days and during the time as specified by the Management. The Management may further notify the calendar days as Purple and White Days as well as another category which might be notified to the member from time to time.

Eligibility:

Persons indicated in clause "category of membership" hereinabove can offer their application for membership as per the details as given in Clause "Procedure" hereinbelow. No individual member or corporate who has been declared an undischarged insolvent or convicted by a court of law shall be eligible for membership.

Corporates shall be eligible to nominate a fixed number of persons for some time as provided for in the Fee Structure.

DEFAULT CLAUSES

a. The application must be submitted with Identity Proof and Address Proof. Vacation charges should be paid online in favor of Karlton Assets & Developers.

b. Applicants must submit a duly filled application form, KYC documents, and payment. Management of Karlton Holidays has the right to accept or reject any application without assigning any reason.

c. Cash remittance, if any, must be made only to Karlton Assets & Developers. – Accounts Department. The company is not responsible for cash paid to any sales personnel or associates.

2. Vacationers Usage Rules:

a. A Vacationer is entitled to use the enrolled membership nights every year as per the membership.

b. The calendar year is divided into 365 days with Peak and non-Peak Seasons.

c. The accommodation shall be provided in Standard rooms subject to availability.

d. Vacationer/User is entitled to accommodation for the selected time and period.

Either for two adults with one kid below 12 years of age.

A standard room can accommodate a maximum of two adults along with one washroom only.

Children above 12 years of age shall be considered as adults. The criteria for age shall vary depending on the terms and conditions of the respective properties/resorts/hotels. Extra beds will be provided at the rate as applicable in the allied properties/resorts/hotels.

e. If traveling with 3 adults, the charges for the extra person will be borne by the Vacationer/User. In case 2 rooms are allotted, nights deducted will be as per multiple apartment booking. All bookings are subject to availability. Disputes or pressure tactics will not be entertained.

f. Vacationer/User may use nights but cannot gift or split nights (2-night minimum) without prior intimation as per booking terms.

g. Vacationers can stay at affiliated/associated/allied properties including those under lease/tie-up agreements.

h. The updated list of alliance properties is available on the company website.

i. Vacation package is valid only upon full payment. Prices may change without notice.

3. Process of Availing Holidays:

a. Members must request reservations using the approved format. Only the principal member may request bookings in joint applications.

b. Reservations are processed on a first-come-first-serve basis, within a 90 to 7 days booking window, subject to availability and eligibility.

c. The Vacationer acknowledges understanding the season and booking policies.

d. Bookings can be made via email or the website login portal.

e. White season members cannot travel during purple season; purple season members have year-round access.

f. International exchange fees (₹1000–₹2000) are applicable based on city/country, duration, and season.

g. Karlton Assets & Developers. is not liable for service failures due to war, natural disasters, pandemics, legal restrictions, or other uncontrollable events.

4. Particulars of Vacationer Packages:

a. First applicant in multiple applications has the right to choose the date. Bookings are confirmed via email based on availability.

b. Bookings cannot be canceled and will be counted as used.

c. Benefits can be availed only after full payment and receipt of card/kit.

d. Karlton Holidays may withdraw properties without prior notice.

e. Bookings are first-come-first-serve and based on available inventory.

f. Exchange/state/luxury taxes must be paid by the Vacationer/User.

g. Force majeure and similar limitations apply as in earlier clauses.

5. General Conditions:
a. All vacation charges/membership/gateway fees are non-refundable under any circumstances.

6. Taxes:
a. Vacationers must pay all applicable taxes. Non-payment will result in denial of services and termination of membership.

7. General:

A. The Vacationer confirms to purchase and accepts the product subject to these terms.

B. Only the benefits listed in this agreement are applicable.

C. Travel elements like pickup, sightseeing, meals, and flights are complimentary and subject to availability, not guaranteed.

D. The Vacationer agrees to abide by all evolving rules and decisions by Karlton Assets & Developers management.

E. Applicable Indian laws will also govern the Vacationer agreement.

F. This agreement supersedes all verbal or written communications.

G. The Vacationer affirms having read and accepted all terms.

H. Correspondence will be directed only to the first-named applicant.

8. Indemnity Clause:The Vacationer agrees to indemnify Karlton Assets & Developers. from all liabilities, damages, claims, or losses arising from misuse, third-party services, travel issues, or inherent risks at the properties.

9. Arbitration:
Disputes, if any, shall first be addressed to the resolution cell in Ahmedabad. If unresolved, they shall be settled by arbitration in Maharashtra, under the Arbitration and Conciliation Act, 1996. The arbitrator's award is final and binding.

10. Jurisdiction:
All services and disputes are governed by Indian laws, with exclusive jurisdiction in the courts of Mumbai, Maharashtra, to the exclusion of all other courts.

11. Disclaimer

This website is designed and developed by a third-party developer. The website developer is not involved in any transactions, bookings, payments, refunds, or service delivery. All payments, refunds, and services are solely the responsibility of the business owner. Any disputes regarding bookings or payments must be addressed directly with the company.
